The Top Twelve Questions You Should Ask Before Hiring Any Attorney To Represent Your DUI Case .  NOTE: We urge you to print this page and use it as a questionaire when you are interviewing prospective law firms.

These are the TOP TWELVE Questions
you should ask EVERY prospective
DUI Attorney you speak with:

  1.     

Is your practice 100% dedicated to DUI Defense ?
The ONLY acceptable answer: Yes.

  2.     

Will the attorney after whom the Law Firm is named actually be the attorney that appears on my behalf in court?
The ONLY acceptable answer: Yes.
(Here's a nice follow up question if the answer is "no":

Who exactly might I expect the actual attorney in court representing me to be? Any idea? Or will you just pick someone when the court date arrives?)

  3.     

Are you EXTREMELY familiar with the judges and prosecutors that will be involved with my case? Do you have a strong postive relationship with those indivuduals ?
The ONLY acceptable answers: Yes.

  4.     

Have you ever been discplined by the State Bar of California ?
The ONLY acceptable answer: No.

  5.     

Are you a SUSTAINING member of the National College for DUI Defense ? Have you attended at least five of their intensive training events ? The ONLY acceptable answers: Yes and Yes.

  6.     

Are you a "Specialist Member" of the California DUI Lawyers Association ?
The ONLY acceptable answer: Yes.

  7.     

Have YOU, not another attorney that you paid to do trials for you, but have YOU recently had a jury return a verdict of "NOT GUILTY ALL CHARGES" on a DUI case that you PERSONALLY tried in the San Diego Superior Courts? Are those results and dates VERIFIABLE in the San Diego County Superior Court offices ?
The ONLY acceptable answers: Yes and Yes.

  8.     

Have you been through Standardized Field Sobriety Testing training under National Highway Traffic Safety Administration Guidelines ? Did you attend and complete both the student course AND the instructor's course ?
The ONLY acceptable answers: Yes and Yes.

  9.     

Does your firm have a FULL STAFF of qualified, experienced, LICENSED paralegals, legal assistants, DMV consultants and investigators ?
The ONLY acceptable answer: Yes.

10.     

Do you REGULARLY get asked to speak at seminars or give presentations to other attorneys in the area of DUI Defense ?
The ONLY acceptable answer: Yes.

11.     

At my initial FREE consultation, will I actually meet with the attorney that will be PERSONALLY handling my case in court ?
The ONLY acceptable answer: Yes.
(If no, here's a good follow up :

Does your office employ so-called "case-managers" or alleged "paralegals" [read:salespeople] to meet with the prospective clients initially ? Are these alleged "paralegals" actually LICENSED paralegals ? Aside from getting me to sign on the dotted line and write my check, what exactly will your "case manager" do to "manage my case" ? Are you PERSONALLY ever asked to speak to local law enforcement agencies, specifically their DUI Patrol Units, regarding issues in DUI enforcement ?
The ONLY acceptable answer: Yes.

If an attorney (or saleperson acting on behalf of the attorney) cannot answer ANY of these questions in line with what has been provided as "The ONLY acceptable answers", you are not consulting with a law firm qualified to legitimatley defend you in your DUI case.
